Omamteker is battling over the land with businesswoman Peace Barigye.
The land in question measuring approximately 0.028 hectares (0.071 acres) is located on Plot 31A at Uringi Crescent in Busiro County, Entebbe Municipality.
According to Omamteker, in 2021, she discovered that her neighbour, Barigye, had encroached on her land, prompting her to report cases of criminal trespass and malicious damage against Barigye at Entebbe Police Station.
The cases were registered under Criminal Registration Book (CRB) 447/2022, and CRB 703/2022, respectively.
However, Omamteker claims that the files were mishandled by Entebbe Police, leading to a miscarriage of justice.
In a petition dated January 21, 2025, Rosemary Kiiza Omamteker states that she was shocked to discover that two years after her initial complaint, Barigye lodged a counter-complaint against her, registered as CRB 850/2024, which was processed swiftly.
Consequently, Omamteker was summoned to the police to record a statement and was later released on bond.
Following the development, Omamteker sought intervention from the Director of Public Prosecutions (DPP) office, which referred her to Moses Onencan, the regional state attorney at Nakawa.
Onencan advised both parties to engage a government surveyor to conduct a boundary opening and determine which party was at fault.
Omamteker complied with the directive, writing to the Commissioner of Surveys and Mapping at the Ministry of Lands, Housing, and Urban Development to conduct the boundary opening.
A report was subsequently issued and submitted to the police.
The survey report
A copy of the survey report dated November 19, 2024, signed by Arthur Makanga, a surveyor from the land’s ministry reveals that Plot 31B, owned by Barigye, encroached on Plot 31A, owned by Omamteker.
The report concludes that “the boundary opening survey for Plots 31A and 31B Uringi Crescent was successful and clearly indicates some significant encroachments for the two plots.”
Foul play
Omamteker expressed concern that a few days after the survey report’s release, she was informed that the files related to her complaints had been closed by Annet Nabulobi, the state attorney in Entebbe Chief Magistrates Court, without justification.
In contrast, the file on CRB 850/2024, which was opened by Barigye, remains active to date.
“I believe the disparity in handling these cases is malicious, driven by a serious ulterior motive to subject me, my daughter, and workers to malicious prosecution,” Omamteker said.
She added, “The other party has encroached on my land, yet the justice keepers are aiding her by having me and my family members arrested.”
The former Uganda Airlines flying captain, Darlington Omamteker, expressed frustration that the state attorney has disregarded a survey conducted by the land’s ministry, which clearly indicates who is at fault in the land dispute.
